Please read these Terms of Service carefully before using the my-column platform. These Terms form a legally binding agreement between you and my-column Inc.
By accessing or using my-column's platform, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.
my-column provides banking infrastructure and Banking-as-a-Service (BaaS) capabilities, including account issuance, payment rails, ledger management, and compliance tooling, accessible via API. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
You must be at least 18 years old and legally authorized to enter into contracts to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
All fees for the Service are set forth in the pricing schedule available at #/pricing and are billed in advance on a monthly or annual basis. Fees are non-refundable except as expressly required by applicable law. We may update pricing with 30 days' written notice.
All content, software, APIs, documentation, and materials comprising the Service are owned by my-column or its licensors and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during the term of your agreement.
You may not use the Service to facilitate illegal transactions, money laundering, terrorist financing, fraud, or any activity that violates applicable law. You may not reverse-engineer, resell, sublicense, or exploit the Service in any manner not expressly permitted by these Terms.
Your use of the Service is also governed by our Privacy Policy, available at #/privacy. By using the Service, you consent to the collection and use of your information as described therein. You are solely responsible for obtaining any necessary consents from your own end users.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. my-column does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, my-column SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
Either party may terminate the agreement with 30 days' written notice. my-column may suspend or terminate your access immediately for material breach, fraudulent activity, or violation of applicable law. Upon termination, your right to use the Service ceases immediately and outstanding fees remain due.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction therein.
We may revise these Terms from time to time. When we do, we will update the effective date below and notify you via email or an in-platform notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
